Legal & Regulatory Environment
While most documents in the power procurement process are publicly accessible on the Central or State Electricity Regulatory Commission’s websites, there are no laws mandating the public disclosure of Power Purchase Agreements (PPAs). Some states require distribution companies to publish tenders in public newspapers during the regulatory approval process.
However, certain state-owned distribution companies, such as Uttar Pradesh Power Corporation Limited, Kerala State Electricity Board, and Transmission Corporation of Andhra Pradesh Limited, have voluntarily shared their PPAs online. Additionally, Maharashtra State Electricity Distribution Company Limited has provided summarized details of its PPAs on its website. In 2016, the Government of India introduced several measures to improve transparency and efficiency in power procurement. The Ministry of Power launched the DEEP e-Bidding & e-Reverse Auction portal for short-term power procurement, while the MERIT platform, developed with POSOCO, provided state-wise details on power costs and purchases.
